Terms & Guidelines
Non Exclusive
No Partnership is Expressed

Work will be executed on a transactional basis, according to the specifications outlined in the Working with 8x10 Dot Photography submission form, found below
-
There is no limit on the number of times one person can propose different projects through submitting the Working with 8x10 Dot Photography form
-
Once the final product/artwork has been shipped for delivery, 8x10 Dot Photography is released from its agreement with its client for the agreed upon project, except where a licensing agreement exits

if there are damages during the shipment and delivery phase (see FAQ on documenting deliveries), 8x10 Dot Photography will work with client and carrier to process the claim and find a resolution

During Any Stage Of The Project

The client and 8x10 Dot Photography agrees to not disclose any information discussed (in any past, present, or future formats) that is part of the project:

Production

Meeting (phone, video, email) discussions

Licensing & Ownership
-
The client may have licensing rights (dissemination of work) of the project/art-piece, depending on what was agreed upon as part of the project, for example:

the amount of copies that are allowed to be made and distributed
-
the length of time/date that this distribution is allowed
-
the materials on to which the image/product is allowed for reproduction
-
other conditions as specified by 8x10 Dot Photography and agreed to with the client
-

A separate licensing agreement will need to be signed
-
At all times, intellectual property rights remain with the artist/8x10 Dot Photography

Termination & Cancellations
Either by 8x10 Dot Phtography or the Client

8x10 Dot Photography will terminate any work requested, during the project speculation or design phase if any of the following has been breached:

agreed upon specifications

basic human rights
-
Potential clients will be advised (via the email address on file) of any termination of delivery before agreeing to any financial transactions

Likewise, the client may also cancel any requested work, and will need to do so during the project speculation or design phase
-
Client's cancellations/changes will not be accommodated once production of the project has began and no refund will be issued

Preventive Measures to Disagreement
Let's Plan to Avoid Disgreements

All agreements on specs., design, material, delivery method, expenses, etc. will need to be completed prior to project commencement and financial transaction
-
these agreements will be documented and referenced throughout the project execution to avoid/resolve disagreements

To satisfy the objective of working together, the client and 8x10 Dot Photography will meet regularly (frequency will depend on project execution lead time) to discuss and review any change requests or agreed upon amendments, to keep the project on track and within scope:

meetings will be conducted via video conference
-
meetings will be limited in time - 10 to 30 minutes to be respectful of both the client's and 8x10 Dot Photography's schedule
-
these meetings will be documented (summary via email or other agreed upon written format) and referenced to resolve any disagreements
-

Resolution Process
-
Either the client or 8x10 Dot Photography shall first attempt to resolve any issues by communicating directly with each other
-
If a resolution cannot be negotiated through personal discussions, within thirty (30) days, either the client or 8x10 Dot Photography can assign a mediator (at their expense) to resolve the issue(s)
-
If further action is required to reach a resolution, both the client and 8x10 Dot Photography will proceed to arbitration
-
with one (1) Arbitrator selected and paid for by the party raising the claim
-
final agreement of work order/contract will include more details of this process, as decided upon by both client and 8x10 Dot Photography

Specifics of any arbitration /negotiation/mediation proceedings:
-
will be held either in the city of Toronto (Canada), or for international clients, an ODR platform
-
proceedings will be conducted in the English language
-
all claims/issues will be submitted via written (electronic) communication
-
